situation:
Capital punishment was abolished from the Criminal Code on December 10, 1999, when the Constitutional Court considered the death penalty to be against the spirit of the new Constitution approved by a popular referendum on November 22, 1998. The Constitution sanctions the principle that "in Albania man's life is protected by law". 
On June 1st, 2007, Protocol No. 13 to the Convention for the Protection of Human Rights and Fundamental Freedoms, concerning the abolition of the death penalty in all circumstances, entered into force.
The last execution in Albania took place in 1995.
On December 19, 2016 as in previous years, Albania co-sponsored and voted in favour of the Resolution on a Moratorium on the Use of the Death Penalty at the UN General Assembly.
On 29 September 2017, Albania voted in favour of the Resolution on the Death Penalty at the 36° session of the UN Council on Human Rights
