KENYA: MAN CONVICTED TO DEATH FOR ROBBING CHINESE BOSS SH30,000

A Kibera court on 22 February 2022 convicted a man to death for attacking his Chinese boss at an apartment in Kilimani and violently stealing his cash and phone.
Robert Kubasu was convicted by Kibera senior principal magistrate Esther Boke after the prosecution proved the cases against him.
Court prosecutor Nancy Kerubo called the five witnesses who testified in the case.
While testifying in court, Chen Daisheng told the court that the attack happened when he was waiting for a lift.
He told the court that he entered the lift and found the accused person in it.
“When I entered the lift I came across Robert my employee and we stayed in there together,” he told the court.
He said that he was shocked when the accused person turned against him and attacked him moments later.
“I opened the main door of the unit and all of a sudden I saw Robbert removing a panga and started threatening me by waving it and shouting a language that I could not understand,” he told the court.
He told the court that his house help came and helped him out since she interpreted the words the accused person was saying.
The court heard during the trial that the accused person demanded that he be given some cash by the complainant in the case.
“He waved the panga to me and threatened to cut me. He demanded that I give him Sh30, 000 and after that, he ran away,” the court was told.
The accused person took the said money and phone from the complainant and ran away.
The matter was reported to Kilimani police station and the accused person was arrested.
The charge sheet says that the accused person committed the offence on September 25, 2019, at the Silver harbour in Kindaruma road in Dagoreti sub-county in Nairobi.
While reading her verdict, Boke said that the prosecution proved the case against the accused persons.
She told the court that she also considered the mitigations from the accused person and ruled that the offence committed was a serious offence.
She convicted him to a death sentence after court prosecutor Nancy Keruvo called for a tough penalty.
She gave him 14 days to appeal if he wished to do so.
