The California Supreme Court has upheld the constitutionality of Proposition 66, a ballot initiative that was billed as a referendum to speed up death penalty appeals. However, the court ruled that the core feature of the referendum—time limits imposed on preparing and deciding state capital habeas appeals—was advisory rather than mandatory and ruled that defendants could raise case-specific challenges to the time limitations and to limitations on the types of issues the Proposition permits them to raise.
