USA - Florida. Citing Hurst, the Florida Supreme Court vacated the death sentence of Randall Deviney

The Florida Supreme Court affirmed Randall Deviney's murder conviction but, citing Hurst v. Florida and Hurst v. State, ordered a new penalty phase. Deviney, 26, White, was convicted of 1st degree and a jury recommended death by an 8-to-4 vote, which was accepted by the court. But last year, the U.S. Supreme Court found the Florida's death penalty sentencing procedure to be unconstitutional because a recommendation did not require a unanimous jury. Deviney was found guilty of killing his neighbor, Delores Futrell, in 2010, but the Florida Supreme Court overturned the ruling. The court determined police coerced Deviney's confession. A 2nd jury found Deviney guilty of 1st degree murder in 2015. (See also 18/03/2010, 11/06/2010, 22/02/2013, 23/07/2015, 14/10/2015).
