Cornelius Baker’s Death Sentence Commuted to Life In Prison
Baker, now 35, Black, was sentenced to death on March 4, 2009 (see) for kidnapping and killing Elizabeth Uptagrafft, 56, from her home Jan. 7, 2007. On March 23, 2017 (see) the Florida Supreme Court vacated the death sentence, citing Hurst, because he had been sentenced to death based upon a 9-3 jury recommendation.
“The state has spoken to the next of kin in this case,” Assistant State Attorney Jason Lewis, who prosecuted the case, told Circuit Judge Raul Zambrano. “We’ve consulted and made a decision that we were not going to be seeking the death penalty anymore. And we would ask the court, obviously, the only other appropriate penalty would be life in prison. So we ask the court to sentence him to life in prison today.”
