Number of prisoners who have obtained relief under Hurst: 100. Total number of prisoners whose cases have been reviewed in light of Hurst: 120. Number of prisoners who have obtained relief under Hurst: 100 (83.33%). Number of prisoners who have been denied relief under Hurst: 20 (16.67%). The Florida Supreme Court has declared that it will apply its decisions in Hurst v. State and Asay v. State—which held that non-unanimous jury recommendations of death violate the Florida state constitution and the Sixth Amendment of the U.S. Constitution—to new death penalty cases and to older cases in which the direct appeal process was final on or before the U.S. Supreme Court decided Ring v. Arizona in June 2002. DPIC has determined at least 150 prisoners on Florida's death-row meet these twin criteria, of whom at least 100 (or 66.67%) have already obtained relief — which means that they will be entitled to resentencing. At least six of the prisoners who obtained relief under Hurst have since been resentenced to life. According to the Florida Department of Corrections death-row roster, 364 prisoners remained on Florida's death row as of July 19, 2017. That list, however, includes people who are no longer sentenced to death because their death-sentences have been overturned as a result of Hurst and who have not yet been resentenced to either life without parole or death.
