USA - Florida. The Florida Supreme Court has overturned the death sentence of Robert Bailey

The Florida Supreme Court has overturned 5-3 another sentence based upon its decision in Hurst v. State declaring that death sentences imposed after non-unanimous jury recommendations for death violated the Sixth Amendment and the Florida state constitution.  The court granted a new penalty hearing to Robert Bailey, whose jury voted 11-1 for death. Bailey, 34, White, was convicted to killing Panama City Beach Police officer Kevin Kight during a traffic stop on March 27, 2005. Bailey was sentenced to die on April 11, 2007 (see).
