USA - Florida. The Florida Supreme Court is ordering new sentencing hearings for John Sexton because a jury did not unanimously recommend the death penalty

03 July 2017 :

The Florida Supreme Court is ordering new sentencing hearings for John Sexton because a jury did not unanimously recommend the death penalty, in what are now often referred to as "Hurst motions". The state court said anyone sentenced after a 2002 ruling could be eligible for a new sentence. Among those getting a new hearing is John Sexton, 53, White, whose jury, in 2013, had recommended death by a vote of 10-2. Judge Mary Handsel formally sentenced Sexton on December 13, 2013 (see) for the Sept. 22, 2010 murder and rape of a 94-year-old woman, Ann Parlato.
