USA - Florida. The Florida Supreme Court overturned the death sentence of Raymond Morrison

The Florida Supreme Court overturned the trial court's grant of a new trial to Raymond Morrison, but upheld's the trial court's determination that Morrison had received ineffective representation in the penalty phase. Morrison, 49, Black, was sentenced to death in Duval County on December 18, 1998, for the January 8, 1997 murder of 82-year-old Albert Dwelle. On October 5, 2015 Circuit Judge Henry Davis (the same judge that sentenced Morrison in 2008) ruled that the lawyers who originally defended Morrison did an ineffective job representing him. Morrison was convicted of slashing the throat of Dwelle, and a jury unanimously recommended death with Davis concurring. But in his ruling throwing out the conviction, Davis said the errors committed by defense attorney Refik Eler led him to believe Morrison never had a chance at a fair trial. Today the Supreme Court overturned the grant of a new trial, but ordered a new sentencing hearing.
