The High Court of Shah Alam, Malaysia, on 4 January 2023 sentenced three men to death after finding them guilty of trafficking a total of 585.1gm of drugs into the country four years ago.
Judge Abdul Halim Aman found that C Peter Yesudas, 55, V Kasinathan, 43, and K Nagaraj, 57, had failed to raise reasonable doubts against the charge.
He said their testimony was more of a denial and afterthought, and not supported by concrete evidence.
Halim said they were found to be in direct possession of the drugs in a cowshed which they had control of.
The trio were charged alongside M Radakrishnan, 52, and S Balaguhan, 50.
Radakrishnan died in custody, while Balaguhan is on the run.
All five were charged with trafficking 432.5gm of heroin and 152.6gm of monoacetylmorphine in a cowshed at Jalan Bukit Beruntung in Rawang at about 12.40pm on 26 November 2019.
They were charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which provides the death sentence upon conviction.
The prosecution was led by deputy public prosecutor Zuraini Abdul Razak, while the three accused were represented by lawyer Norman Mohd Nasir.
