The Peshawar High Court (PHC) upheld the death sentence to 35 militants and life imprisonment to two others awarded by the military courts.
A two-member bench of the PHC headed by Chief Justice Yahya Afridi said the sentence of two militants was against the law and referred those cases back to the military courts. The court had reserved its verdict on the petitions filed by the relatives of 39 militants last month. The court said 37 militants were given right to defence, therefore, their sentences are according to law.
Meanwhile, the PHC stayed the execution of former Swat Taliban spokesman Muslim Khan. Muslim Khan was awarded death sentence by a military court, which was challenged by his wife, Nida Bibi in the PHC. Counsel for Nida Bibi told the court that Muslim Khan’s family did not know anything about the trial proceedings.
