Cesar Fierro was released and returned to Mexico. Fierro, a Mexican national, was sentenced to death in 1980 by an El Paso jury in the 27 February 1979 murder of a cab driver in El Paso. At the time of the crime he was 23. On December 18, 2019, the Court of Criminal Appeals overturned Cesar Fierro’s death sentence in light of a 1989 U.S. Supreme Court ruling, Penry v. Lynaugh, which established jurors must be given the opportunity to fully consider all mitigating evidence during the punishment phase of capital trials. After the El Paso County DA opted not to pursue another death sentence, Fierro was resentenced to life in prison in January 2020 at the age of 63. Under the statute in effect in 1980, and the length of their incarceration, he was immediately eligible for parole. In March 2020, the Texas Board of Pardons and Paroles granted parole. Fierro was released and returned to Mexico on May 14, 2020
