MALAYSIA: DEATH SENTENCE APPEAL DISMISSED

The Court of Appeal in Sabah State, Malaysia, upheld the death sentence of a jobless man who was convicted on a charge of murdering a 51-year-old man five years ago.
The three-man panel comprising Court of Appeal judges Datuk Abdul Wahab Patail, Datuk Mohamad Ariff Md Yusof and High Court judge Datuk David Wong Dak Wah unanimously dismissed an appeal by Lee Fook, 44, after hearing submissions from both the appellant and the respondent.
The High Court had on February 24, 2010, sentenced Lee to hang for killing the man at Taman Bambangan in Kampung Madsiang, Jalan Tambunan, Penampang on July 24, 2008.
The offence was framed under Section 302 of the Penal Code which carries the death sentence, upon conviction.
Deputy public prosecutor Siti Rafidah Zainuddin appeared for the respondent while counsel Mohd Fauzi Formusa represented Lee.
