KENYA: MAN SENTENCED TO DEATH FOR DEFILING MINOR
November 4, 2014: A 34 year-old man has been sentenced to death in Kenya after he was found guilty of defiling a six year-old girl before dumping her body at a coffee plantation estate.
While delivering the judgment, High Court judge Nicholas Ombija said the prosecution had proven its case against Bernard Wamuti Kamau and the suspect should therefore be handed the death sentence as prescribed by law.
Wamuti, who used to work as a watchman in Runda estate in Nairobi County before his arrest six years ago stood in the dock motionlessly keenly listening to the judgment.
The deceased is said to have disappeared on the evening of 5th January 2009 and after a long search by family members, the body of young girl Florence Manda was found dumped at a coffee plantation in Kiramara estate in Kiambu county.
According to a report compiled  by the government chemist Stephen Matinde, blood samples and vomit taken from the minor matched with that found on the trousers and t-shirt of suspect.
In his ruling, Judge Ombija said that the prosecution had proven its case beyond reasonable doubt and discarded the evidence given by Wamuti who had returned a not guilty verdict.
Ombija observed that Wamuti contradicted his testimony. (Sources: kbc.co.ke, 04/11/2014)
