SINGAPORE: CONDANNATO A MORTE PER TRAFFICO DI CANNABIS

Un ex agente immobiliare il 2 aprile 2024 è stato condannato alla pena di morte obbligatoria a Singapore per traffico di cannabis, con il giudice che ha respinto la sua affermazione secondo cui la sostanza era destinata a un’attività di ricerca.
La sentenza, emessa dal giudice See Kee Oon della 2° Divisione d'Appello, ha ritenuto Seet Poh Jing colpevole di detenere non meno di 4509,2 g di cannabis a fine di traffico.
Seet, ex agente di vendita immobiliare presso Huttons Asia, è stato arrestato il 28 giugno 2018 dopo che gli agenti del Central Narcotics Bureau (CNB) hanno sequestrato cinque blocchi di materiale vegetale da un'auto. L’analisi ha appurato che i blocchi contenevano non meno di 4509,2 g di cannabis, definita dallo stesso Seet "erba".
Due telefoni cellulari appartenenti a Seet sono risultati contenere messaggi inviati che pubblicizzavano la sostanza.
Seet è stato rappresentato dagli avvocati di Andre Jumabhoy LLC e Sterling Law Corporation, secondo cui il loro cliente intendeva utilizzare la droga per la ricerca piuttosto che per il traffico.
Hanno sostenuto che Seet avesse sviluppato un fascino per la cannabis, non solo per il consumo ma anche per la sua coltivazione e i potenziali usi del cannabidiolo, un ingrediente derivato dalla cannabis. Aveva consultato diversi contatti a partire da marzo 2018 riguardo alla possibilità di avviare un'attività legata alla cannabis.
La difesa si è basata anche su una perizia psichiatrica secondo cui Seet ha sofferto di un "episodio ipomaniacale indotto da farmaci", che "ha contribuito in modo significativo al suo comportamento sconsiderato e impulsivo all'epoca dei fatti", mentre utilizzava sostanze per l'estrazione dell’olio di cannabidiolo, come parte dei suoi "grandiosi piani per avviare un business della cannabis".
Tuttavia, l’accusa ha sostenuto che la sua difesa fosse un mero ripensamento e incoerente con altre prove. Ha inoltre sostenuto che Seet non soddisfacesse i requisiti diagnostici per il disturbo ipomaniacale indotto da sostanze.
Il giudice See ha ritenuto che Seet non sia riuscito a dimostrare la tesi della ricerca, descrivendola come un "ripensamento inventato".
Ha fatto riferimento alle dichiarazioni di Seet alle autorità dopo l'arresto, sottolineando l'assenza di qualsiasi menzione della ricerca fino alla fase del processo.
Il giudice ha anche fatto riferimento a una parte della dichiarazione resa da Seet il giorno dopo il suo arresto, in cui l'imputato affermava che la miscela di cannabis aveva lo scopo di aiutare gli amici "danneggiati" che "hanno bisogno di aiuto e senso di appartenenza e anche di dare loro un senso di sicurezza".
Le successive dichiarazioni di Seet, inclusa quella fatta un mese dopo, che descriveva in dettaglio la sua strategia di prezzo per la vendita dell’erba, che secondo lui dipendeva dalle capacità finanziarie dei suoi amici, non menzionavano la ricerca, ha osservato il giudice See.
"Nonostante le dichiarazioni di entusiasmo di Seet per la sua nuova impresa di ricerca e sviluppo, Seet evidentemente non possedeva il know-how e non aveva intenzione di estrarre il cannabidiolo", ha detto.
Il giudice ha osservato che Seet credeva che fosse solo questione di tempo prima che la cannabis fosse legalizzata a Singapore.
